2003 AY Action 04 Text

Resolution 4 Resolution for Equal Opportunity in Law School Recruitment Passed November 24, 2003

Whereas, the GPSA values the vibrant and diverse social and cultural backgrounds of the graduate and professional students of Cornell University; and

Whereas, the GPSA is committed to upholding the nondiscrimination policies of each of the individual schools of Cornell University that protect free and robust academic discussion and provide for equal opportunities for all its students; and

Whereas, the Cornell Law School is committed to a policy against discrimination in employment based on race, color, religion, national origin, ancestry, sex, sexual orientation, marital status, age or handicap, and requires employers using the Cornell Law School Career Office for recruitment purposes to affirm their commitment to this policy; and

Whereas, the Association of American Law Schools requires its member schools to adopt and enforce such a policy of equal opportunity and nondiscrimination; and

Whereas, the “Don’t Ask, Don’t Tell” policy of the Department of Defense and the JAG Corps violates the nondiscrimination policies of Cornell Law School and the Association of American Law Schools by discriminating on the basis of sexual orientation in recruiting and hiring practices; and

Whereas, the law known as the Solomon Amendment (10 U.S.C. � 983) denies federal funding, other than student financial assistance, to any university, if any part of that university has a policy or practice that denies military recruiters the same access and privileges afforded other employers; and

Whereas, the enforcement of the Solomon Amendment by the Department of Defense has forced Cornell Law School to violate its own nondiscrimination policy and that of the Association of American Law Schools; and

Whereas, the Forum for Academic and Institutional Rights (FAIR) is an organization of law schools and law faculties dedicated to preserving the right of academic institutions to enforce their policies without the fear of government intrusion and the revocation of federal funding;

Be it therefore resolved, that the GPSA encourages the faculty members and administration of Cornell Law School to join FAIR in an effort to uphold its nondiscrimination policy; and

Be it further resolved, that the GPSA requests President Lehman to encourage and permit Cornell Law School and its faculty members to join FAIR.
