April 22, 2012 Letter From President Re: R. 7

Dear Melissa,

Thank you for forwarding Resolution 7 passed on April 10th by the University Assembly. I have been following the proceedings of the Codes and Judicial Committee and the University Assembly and have been gratified by the measured and deliberate consideration given to this consequential issue.

After carefully reviewing the various perspectives expressed over the past year and the two options presented in Resolution 7, I have decided to accept the recommendation set forth in sub-paragraph 2 of the first “Resolved” clause of Resolution 7, i.e., that offenses involving sexual harassment and sexual assault be transferred from the jurisdiction of the Campus Code of Conduct to Policy 6.4. I anticipate that the policy promulgation process under Policy 4.1 will be initiated promptly so that Policy 6.4 may be expeditiously amended to address this new coverage of non-employment related conduct. I recognize that strong views have been expressed for and against this change and that sound arguments have been advanced by both proponents and opponents of the change. I am convinced, however, that shifting offenses involving sexual harassment and sexual assault to Policy 6.4 will strike the appropriate balance between the complainant and the accused, will provide a fair and expeditious process for resolution of complaints alleging these offenses, and will appropriately address legal mandates under Title IX.

I very much appreciate and welcome the participation of the University Assembly as a stakeholder in the process of amending Policy 6.4 and know that the community will benefit from the “robust participation” of the University Assembly. I also agree with the University Assembly that there should be increased efforts to educate the community with respect to sexual harassment and sexual violence. I know that such efforts are already underway and I anticipate that the Title IX working group and others will continue to devote substantial effort in this regard.

I have also reviewed and considered Resolution 6 passed by the University Assembly. I now accept the recommendations in Resolution 6 as an interim measure until the necessary changes to Policy 6.4 have been adopted.
