President's Response to Resolutions 7, 8, and 9

Dear Jim,

Thank you for email of April 24th presenting UA Resolutions 11, 12 and 13.

Regarding UA Resolution 11 (R7 Online), Toward New Destination and Cornell’s Campus Climate. I appreciate the spirit of this resolution, and am pleased to know the University Assembly supports the university’s diversity initiative.

I consulted Associate Vice President Lynette Chappell-Williams and Senior Vice Provost Laura Brown in reviewing this resolution, and am recommending the following changes: � Line 22: should read—“has released the findings from these studies”�all campus climate study findings have been released. � Line 30: should read—“one or more representatives from the University Diversity Council will meet with the University Assembly”�it is the responsibility of the UDC to promulgate this information. The UDOs are members of the UDC. I am not able to promise that all five UDOs will be present at this regular meeting. � Line 35: should read—“the University Diversity Council shall inform the University Assembly”�as above, it is the responsibility of the UDC to promulgate this information. � Line 48: should read�”the ‘University Diversity Council’ shall make the request of the units who submit TND initiatives to publicize them on their divisions website and through physical materials.” —Only the provost and I can require colleges and units which report to us to follow instructions about publicizing initiatives on their web sites or through physical materials.

Regarding Line 40: we can make the information about Toward New Destinations outcomes and initiatives more readily accessible, and will explore a solution for the sortable data you request. In the meantime, it will continue to appear as a list.

If you agree to the changes outlined above, I will be pleased to accept this resolution. Please know I appreciate very much the Assembly’s commitment to diversity and inclusion.

Regarding UA Resolution 12 (R8 Online): Updated Resolution to Modify Campus Code to Clarify the Rights of Complainants to Appeal Summary Decision Agreements. I understand this resolution was initiated by the Judicial Administrator to clarify the timelines related to summary decision appeals, and I appreciate the cooperative effort of the University Assembly and the JA’s office to work together to bring this clarity to the Campus Code.

With one recommended change, I accept this resolution: � Line 88: should read —“This petition must be received by the Judicial Administrator within eight business days.” —the intent is that the complainant would have three days after they receive notice from the JA, which, as noted on Line 73 is five days from the deadline for revocation of the SDA.

Please confirm to me whether you support the alternative language I have suggested. With your confirmation, I approve the incorporation of this alternative in the Campus Code of Conduct.

Regarding UA Resolution 13 (R9 online): Updated Resolution to Transfer Title IX Cases to Cornell University Policy 6.4. I appreciate the initiative taken by the University Assembly to align the Campus Code with the University Policy. I understand this resolution makes the administrative adjustments needed to formally integrate University Policy 6.4 into the Campus Code of Conduct, and I accept this resolution and proposed changes to the Campus Code.
