Response from the President

Dear Jim,

Thank you for submitting UA R9 (R5 online), Resolution to Clarify Responsible Free Expression in the Campus Code of Conduct. I appreciate the efforts taken to review this complex situation, including all of the relevant reporting, recommendations and comments, and especially the efforts taken by the Codes and Judicial Committee to reconcile the conflicting policy provisions of the Campus Code.

With the following minor change and request, I am prepared to accept this resolution.

Line 39: should read, �so long as demonstrators do not disrupt� � Replacing �they� with �demonstrators� clarifies the clause.

Separately, I note that the �Whereas� clause of lines 21–25 addresses a limited advance-notice procedure to allow staff to adequately prepare and safeguard participants. I ask that you convene the CJC in the next session of the Assembly to introduce this language as a resolution of its own. I would be pleased to consider such a companion resolution that not only aligns with this whereas clause, but also is in accord with the �time, place and manner restrictions� language that has long been in the Code.

Because there still remains ambiguity and conflict between the Campus Code and the various �use-of outdoor space� policies on campus, I will convene a work group to examine and make recommendations to reconcile the conflicting policy provisions.

Please confirm to me whether you support the change I have suggested. With your confirmation, I approve the incorporation of this resolution in the Campus Code of Conduct. Thanks once again for your ongoing leadership.
